Terms and Conditions

‘Cre8ive Words’ refers to the business with Australian Business Number (ABN) 32 752 307 875, and ‘Client’ refers to the entity who uses Cre8ive Words to conduct proofreading, editing or writing services, or contracts Cre8ive Words to conduct these services.

Client Information and Obligations

The Client is responsible for providing true and accurate information with respect to name, phone number, postal and email address, and all payment details. Failure to provide true and accurate information may result in termination of the agreed service/s. The Client assumes all responsibility for any problems, costs, errors and issues, as well as legal liability resulting from such false information, whether intentional or accidental.
The Client must also provide all necessary information, documents and assistance to enable Cre8ive Words to perform its services under the Terms and Conditions. Cre8ive Words cannot be held liable for any damage to, or loss of information, and cannot be held responsible for the outcome resulting from the use of any of its services including school/university grades, business sales and any other purpose for which Cre8ive Words documents are used.

Ownership of Intellectual Property

The Client retains sole copyright ownership and control over all materials submitted to Cre8ive Words, and any intellectual property generated or created through Cre8ive Words for the Client automatically resides with the Client, after full payment has been made for the service rendered.

Data Security, Confidentiality and Personal Privacy

Cre8ive Words is committed to providing a secure and reliable service, and promises that all documents and information submitted by the Client – by email, disk, USB or hard copy – are confidential and will be kept securely and safely at all times. We use industry-standard security measures on computer systems and communication networks that are designed reasonably to protect information contained within these systems from misuse, loss, unauthorised access, modification or disclosure. Unfortunately, the transmission of information via the Internet is not completely secure, and although we will do our utmost to protect your information, any transmission is at your own risk and Cre8ive Words will not be held liable for online theft or fraud.

Likewise, all names, postal and email addresses, phone numbers and other customer information will be kept private and confidential, and will not be sold, given away or traded to any other person or any company without your consent. Upon payment and final delivery of your documents, all soft and/or hard copies submitted by the Client are held for a period of 30 days and then destroyed.

Content of Submitted Materials

Cre8ive Words reserves the right to refuse to proofread/edit/write any document that advocates or incites violence, hatred or discrimination in contravention of national and international laws, or is personally offensive. Additionally, Cre8ive Words does not endorse, recommend, or support the content of any documents provided by the Client.

The Client declares he/she is authorised to use all documents and information provided to Cre8ive Words for the purposes of service or payment of service, and is advised that plagiarism and the breach of copyright are serious offenses, and Cre8ive Words assumes no responsibility or liability for the infringement of third party copyright in the content of said documents.

The Client is also responsible for the accuracy of all dates, facts, figures, tables, graphs and other technical information provided, unless specifically stipulated and scoped in the statement of work. Cre8ive Words is also not liable or responsible for any damage to computer hardware or software arising from the distribution of a computer virus.

Submitted Documents – Format and Archiving

The Client must submit work to Cre8ive Words via email (Word attachment), on disc or USB, or in hard (paper) copy through regular post. The Client must inspect returned proofread/edited/written documents and advise Cre8ive Words of any amendments within three (3) days of receipt. Cre8ive Words will archive copies of electronically edited work for 30 days from the date of returning documents to the Client. Should a Client lose or delete his/her proofread/edited/written text during that 30-day period, Cre8ive Words may be contacted to retrieve the materials. Cre8ive Words will not retain a copy of proofread/edited/written work submitted in paper format.

Quotations

If a quotation is required, it will be provided to the Client via email. Quotations are valid for 30 days from the date of issue. Once a quotation is accepted, the Client is required to pay a deposit of 50% of the total amount quoted, prior to work commencing. All additional materials required to complete the proofreading/editing/writing task must be submitted electronically via email, disk, USB or hard copy. This will include any in-house style guides and preferred dictionary.

Pricing and Payment

The services offered by Cre8ive Words and the various pricing methods can be accessed via the Rates and Payments tab on this website There is a minimum charge of AU$44.00 for any service and Cre8ive Words reserves the right to change the rates at any time. Once the nominated proofreading/editing/writing services are completed, Cre8ive Words will issue an invoice to the Client, who is then required to pay the final amount within seven (7) days of the invoice date. All documents will be returned to the Client once full payment is made.

Payments are to be made in Australian dollars via direct bank deposit (these details will be provided on the invoice) or by cheque (by prior arrangement). For larger projects, or projects with long timelines, Cre8ive Words reserves the right to request payment by instalments. If a Client is dissatisfied with any proofreading/editing/writing service, Cre8ive Words will review the document once more upon completion of services at no extra cost, provided full payment has already been made. Any further changes will be charged at the original rate quoted.

Returning Documents

Cre8ive Words will return work to the Client in the same way it was received – email, disk, USB (if provided) or hard copy – unless otherwise nominated and agreed to by both parties at the time of submission. Printing will be the responsibility of the Client. If the Client requests the postage/courier delivery of documents, all delivery costs will be covered by the Client. Cre8ive Words will not be held responsible for delays or losses due to events beyond its control (Australia Post/courier delivery delays, etc.).

Cancellations

No cancellation fee applies if the Client wishes to cancel his/her order; however, the Client must send a written request not to proceed with work. If work on the order had begun before receipt of the cancellation order, Cre8ive Words is entitled to invoice the Client for any work already completed to that date.

Service Quality and Standards

Cre8ive Words provides Clients with the best possible quality of service, and all documents are proofread/edited/written to a high and exacting standard; however, Cre8ive Words provides no guarantee that a Client’s work will be completely free of errors. And while we will make making the best efforts possible to match a Client’s requested tone and style, we cannot be held responsible for not meeting expectations in terms of a creative or stylistic result. If Cre8ive Words has any questions for the Client in relation to creativity or style, and it cannot reach the Client at the indicated email address or phone number/s, Cre8ive Words will choose a style that is most suitable

Cre8ive Words will make every effort to meet deadlines and communicate with the Client in the case of technical problems; however, Cre8ive Words is not liable or responsible for service delays resulting from unforeseen circumstances such as technical problems that are beyond our control, including server or connection issues, or from any other cause relating to the Client’s inability to access the system or these materials, whether or not the circumstances giving rise to such cause may have been within the control of Cre8ive Words or of any vendor providing software or services support.

Termination/Refusal/Denial of Services and/or Contractual Obligations

Cre8ive Words reserves the right to terminate all services or contractual obligations with the Client if any of the Terms and Conditions contained in this document are violated. Cre8ive Words also reserves the right to reject any work, or refuse service to any existing or prospective Client for any reason.

Indemnification

The Client irrevocably agrees to indemnify and hold Cre8ive Words – its subsidiaries, affiliates, agents, officers and employees – harmless from any claim or demand, including reasonable fees and costs made by any third party due to or arising out of the Client’s use of this website or service, the violation of the Terms and Conditions by the Client, or the infringement by the Client of any intellectual property or other right of any person or entity.

Acceptance of the Terms and Conditions

These Terms and Conditions contain the entire agreement between the parties and each party acknowledges they have not relied upon any written or oral representations made to them by the other party. By contracting Cre8ive Words, the Client acknowledges he/she has read, understood and agrees to the Terms and Conditions contained in this document. All transactions and correspondence are bound to these Terms and Conditions.
